INTRODUCTION

These Terms of Use and Privacy Policy (the “Terms” or “Policy”) explains how Pronoss, LLC (“Pronoss”, “we”, “us”, or “our”) collects, uses, shares and processes information obtained through www.Pronoss.com and our social media sites (which we call our “Site” or “Sites”) and governs your use of the Site.   • Employment Information. Career, education, and employment related information, such as job preferences or interests, work performance and history, salary history, status as a veteran, nationality status, professional licensure information and related compliance activities, accreditations and other professional accolades may also be collected if you provide them to us via the Site.

Our Processing

We process personal information in connection with our Site and for other business purposes as follows:

We do not currently respond to, or take any action with respect to web browser “do not track” signals or similar mechanisms as there is no uniform implementation of the same. We will share your personal data internally within Pronoss to help facilitate your requests and provide information to you.

We may disclose personal information that we collect or you provide to service providers and other third parties we use solely to support our business (such as the management and maintenance of the Site, services related to recruitment or employment applications, communications with you and the like). If we cannot initially verify your identity, we may request additional information to complete the verification process (such information may include your picture, a copy of your driver’s license or other government-issued ID and/or a recent utility or credit card bill). Please note that if we cannot verify your identity, we may not be able to fulfill your request. We may decline to process requests if we cannot verify the requestor’s identity, if we believe the request will jeopardize the privacy of others, if we believe the change would violate any law or legal requirement or cause the information to be incorrect, or for a similar legitimate purpose. In any case, where we provide information access, deletion or correction, we perform this service free of charge, except if doing so would require a disproportionate effort.

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

LAWFUL BASES OF DATA PROCESSING

We will only collect and process personal data about you where we have a lawful basis. Lawful bases include those uses and disclosures identified in this Policy, your consent, contract, and other legitimate interests. Such legitimate interests include protection to you, us and third parties, to comply with applicable law, to enable and administer our business, and to contact you concerning changes in law, invitation to our events and information about our services. SECURITY AND PROTECTION

We implement industry standard security safeguards designed to protect your data. Our name, logo and all related names, logos, product and service names, designs and slogans are trademarks of Pronoss or its affiliates or licensors. All other names, logos, product and service names, designs and slogans on the Site are the trademarks of their respective owners. You must not use such marks without the prior written permission of Pronoss. No right, title or interest in or to the Site or any content on or offered through the Site is transferred to you, and all rights not expressly granted are reserved by Pronoss. Any use of the Site not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark and other laws. If you feel that any content, material, name or logo used on our Site violates your intellectual property rights, please contact us at the information above. 

AUTHORIZED AND PROHIBITED USES

You may use the Site only for lawful purposes and in accordance with these Terms. We may revise and update our Site as well as these Terms from time to time in our sole discretion. GOVERNING LAW AND JURISDICTION

We are based in Oklahoma and provide the Site for use in the United States. We make no claims that the Site or any of its content is accessible or appropriate outside of the United States. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws. All matters relating to the Site and these Terms and any dispute or claim arising out of or related thereto (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the State of Oklahoma without giving effect to any choice or conflict of law provision or rule, whether of the State of Oklahoma or any other jurisdiction. Any legal suit, action or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the state or federal courts located in Oklahoma City, Oklahoma, and waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

 

ENTIRE AGREEMENT

These Terms constitute the sole and entire agreement between you and us with respect to the Site and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral. If any portion of these Terms is held to be invalid, illegal or unenforceable for any reason, that provision shall be eliminated or limited to the minimum extent and the remaining terms will continue in full force and effect.
